These regulations define the rules for purchasing products through the online store La Włosy, operating at https://lawlosy.pl/en/, hereinafter referred to as the "Store".
SECTION I
Acceptance and execution of orders
The Store conducts sales using the Internet.
Orders are accepted through the Store's websites 24 hours a day, 7 days a week.
An order in the Store may be placed by a person who is at least 13 years old. A person who is under 18 years old (between 13 and 18 years of age) may place an order only with the consent of their legal representative (e.g. parent).
In order to place an order, it is necessary to create an account, hereinafter referred to as the "Customer Account" - create an account. An order may also be placed without creating an account - Purchase without an account.
Immediately after the Customer places an order in the Store, an automatic e-mail is sent to the e-mail address assigned to the Customer Account or provided in the purchase process without creating an account, confirming that the order has been placed correctly. If the Customer chooses the online payment method, the e-mail in question is sent after the payment has been posted to the Store's account. Sending an e-mail confirming the order is not tantamount to concluding a sales agreement.
If the Customer creates an account during the order fulfillment process, the orders placed are visible in the order history on the Customer's Account.
After the order is placed correctly, its processing begins.
After the product is sent, the Store sends the Customer an e-mail confirming the product has been sent. If the Customer creates an account during the order fulfillment process, the order status on the Customer's Account changes to "Sent" at the time the e-mail confirming the product has been sent. The e-mail confirming the product has been sent contains the data of the parties to the agreement.
In the case of ordering multiple products in one order, the Customer may receive several order fulfillment confirmations for individual products.
In the case of online payment made by the Customer and lack of confirmation referred to in points I.8 and I.9, the money is returned to the customer automatically within 24 hours via the payment channel through which the product (products) was paid: e-transfers - refund to account, card payment - refund to card.
VAT invoices or receipts are issued for orders.
SECTION II
Product prices, delivery costs
All prices are given in Polish zloty and include VAT. The store reserves the right to change the prices of products in the offer, introduce new products to the offer, cancel promotional campaigns and introduce changes to them without violating the rights acquired by Customers until the change is made.
Information on the delivery cost is published during the order placement (for each product placed in the basket). This cost is added to the price of the ordered product. The delivery cost for one shipment is PLN 25 or in the case of cash on delivery PLN 30.
SECTION III
Payment methods and terms
The Store offers the following payment methods:
cash on delivery - upon receipt of the shipment by the Customer (the amount is collected by the courier),
card payment,
payment by online transfer (e-transfer),
Payment term:
if the Customer chooses to pay by card, online transfer (e-transfer), the Customer is obliged to make the payment after being automatically redirected to the payment page.
if the Customer chooses to pay cash on delivery upon receipt of the shipment, the Customer is obliged to make the payment upon receipt of the shipment.
SECTION IV
Order processing time
The shipment is delivered by a courier company.
The order is processed by the Store within 24 hours (working days), and the delivery time depends on the courier company's operation and is from 1 to 3 working days from the conclusion of the sales agreement with the Customer.
The shipment is sent to the address of the Customer Account holder or to the delivery address (if the delivery address is different from the address of the Customer Account holder).
 
SECTION V
Right to withdraw from the contract (product returns)
Send the product back in any way to the address for returns and complaints provided on the receipt or invoice.
If you want to exchange the product, return the product you have (you will receive a refund) and order a new one (place a new order).
In accordance with the Act of 30 May 2014 on consumer rights, the Customer has the right to withdraw from the contract for the sale of a product purchased through the Store within 14 days without giving any reason.
The deadline for withdrawal from the contract expires after 14 days from the date on which the Customer came into possession of the item or on which a third party other than the carrier and indicated by the Customer came into possession of the item.
To exercise the right to withdraw from the contract, the Customer must inform the Store ("La Włosy") of their decision to withdraw from the contract by means of an unequivocal statement (e.g. by e-mail, fax or letter sent by post).
In order to meet the deadline for withdrawal from the contract, it is sufficient for the Customer to send information regarding the exercise of the right to withdraw from the contract before the deadline for withdrawal from the contract expires.
Consequences of withdrawal from the contract
In the event of withdrawal from the contract, the Store returns all payments received from the Customer, including the costs of delivering the goods to the Customer immediately, and in any case no later than 14 days from the day on which it was informed of the Customer's decision to exercise the right to withdraw from the contract.
When withdrawing from the contract, it is necessary to indicate the bank account to which the transfer is to be made (in the case of online payment made by the Customer, the account is not indicated, and the refund is made via the payment channel through which the product was paid: e-transfers - refund to the account, card payment - refund to the card).
The Store may withhold the refund until the goods are received or until the Customer provides proof of sending it back, depending on which event occurs first.
The product should be returned immediately, and in any case no later than 14 days from the day on which the Customer informed the Store about the withdrawal from the contract.
The Customer shall bear the direct costs of returning the item (i.e. transport costs) unless the withdrawal was caused by the fact of even a temporary inability of "La Włosy" to provide the service with the properties ordered by the Customer. In the case of using the Store's courier service, the cost of transporting the returned product is PLN 20 (the amount returned to the Customer will be reduced by PLN 20). The Customer shall be liable for any decrease in the value of the item resulting from its use in a way that goes beyond what is necessary to determine the nature, characteristics and functioning of the item.
SECTION VI
Product compliance with the contract, complaints
You can return the product subject to the complaint. Send the product subject to the complaint in any way to the address for returns and complaints provided on the receipt or invoice.
All products available in the Store are original. The Customer who is a consumer has the right to report non-compliance of the product with the contract in accordance with the Civil Code.
The Store is liable for the non-compliance of the sold item with the contract. In particular, the item is non-compliant with the contract if the Customer finds in the delivered product:
manufacturing defects,
mechanical damage caused during transport,
lack of properties that the delivered product should have due to the purpose specified in the contract or resulting from circumstances or intended use,
lack of properties of which the seller assured the Customer,
is not suitable for the purpose of which the Customer informed the Store when concluding the contract, and the Store did not raise any objection to such intended use, its incompleteness.
If the sold item has a defect, the Customer may submit a declaration of a demand for a price reduction or withdrawal from the contract, unless the Store immediately and without excessive inconvenience to the Customer replaces the defective item with a defect-free one or removes the defect.
The Customer may request that the Store replace the defective item instead of removing the defect or repair the item instead of replacing it, unless this is impossible or involves excessive costs.
If the Customer wishes to make a complaint about the product, they should inform the Store by submitting an unequivocal declaration of intent - by fax, e-mail or a letter sent by post to the address "La Włosy". In such a case, the complained product should be sent back in any way to the address for returns and complaints provided on the receipt or invoice. In each case, the customer may use the return service offered by the Store.
The Seller is liable for the non-conformity of the product with the contract if the physical defect is found before the expiry of two years. If the Customer requested the exchange of the item for a defect-free one or removal of defects, the time limit for submitting a declaration of withdrawal from the contract or reduction of the price begins at the moment of the ineffective expiry of the time limit for the exchange of the item or removal of the defect.
Packages returned cash on delivery are not accepted.
Complaints are considered within 14 days from the date of receipt of the complained product by the Store.
The complaint may be considered in the following way:
refund of the money for the product and transport or
delivery of a new product or
repair of the product or
rejection of the complaint.
In the event of acceptance of the complaint, the Store will refund the Customer the cost of transporting the complained product in the amount of PLN 20, and in the event of using a courier sent by the Store and acceptance of the complaint, the Store will bear the cost of returning the complained product.
 
SECTION VII
Out-of-court complaint and claim settlement methods and rules of access to these procedures
Detailed information on the possibility of using out-of-court complaint and claim settlement methods by a Customer who is a consumer and the rules of access to these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Voivodship Inspectorates of the Trade Inspection and at the following websites of the Office of Competition and Consumer Protection:

A Customer who is a consumer has the following exemplary possibilities of using out-of-court complaint and claim settlement methods:
The Customer is entitled to apply to a permanent consumer arbitration court, referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection, with a request to resolve a dispute arising from the concluded Sales Agreement. The regulations for the organization and operation of permanent consumer arbitration courts are specified in the regulation of the Minister of Justice of 25 September 2001 on the regulation for the organization and operation of permanent consumer arbitration courts.
The Client is entitled to contact the provincial inspector of the Trade Inspection, in accordance with art. 36 of the Act of 15 December 2000 on the Trade Inspection, with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Client and the Seller. Information on the principles and mode of the mediation procedure conducted by the provincial inspector of the Trade Inspection is available at the offices and on the websites of individual Provincial Inspectorates of the Trade Inspection.
The Client may obtain free assistance in resolving the dispute between the Client and the Seller, also using the free assistance of the district (municipal) consumer advocate or a social organization whose statutory tasks include consumer protection (including the Federation of Consumers, the Association of Polish Consumers).
Advice is provided by the Federation of Consumers on the toll-free consumer hotline number 800 007 707 and by the Association of Polish Consumers at the email address porad@dlakonsumentow.pl.
SECTION VIII
Order cancellation by the Customer
The Customer may cancel the order until the Store sends an e-mail confirming the commencement of order processing. To cancel the order, use the Customer Account (orders that have been sent to the Customer cannot be canceled).
In the event of placing orders without creating a Customer Account, the Customer cannot cancel the order.
SECTION IX
Parcels not collected by the Customer
The cost of transporting a parcel not collected due to the Customer's fault, together with the cost of returning it to the sender, is borne entirely by the Customer.
SECTION X
Final provisions
In order to properly familiarize yourself with the assortment presented on the Store's websites, and in particular to correctly display product photos, the Customer must use one of the following Internet browsers:
Internet Explorer 5.5 or higher,
Google Chrome,
Firefox 3.0 or higher,
Safari 2.0 or higher,
Opera 7.5 or higher
and a minimum screen resolution of 1024x600 and a 24-bit color palette.
The information contained on the Store's websites does not constitute an offer within the meaning of the provisions of the Civil Code.
By accepting these Regulations, the Customer consents to the delivery of VAT invoices and receipts and, in the case of returns and accepted complaints, VAT correction invoices via electronic channels. VAT invoices and VAT correction invoices are sent by e-mail to the Customer's address in the form of files
The Customer declares that the e-mail address provided by him during registration is the address for delivering invoices, referred to above (item X.3).
The consolidation, protection and provision of the essential provisions of the concluded agreement is made by providing the Customer with a VAT invoice or receipt via electronic channels.
The product sales agreement is concluded in accordance with Polish law and in Polish. The provisions of these regulations regarding transport costs apply only to transactions carried out within the territory of Poland. In the case of delivery of the product outside Poland, the appropriate transport fee rate is displayed next to the product at the stage of placing the order. The rates of foreign transport fees are available in the Transport tab, delivery price list https://lawlosy.pl/oplata-i-dostavka/ The store does not offer its own courier service for handling returns/complaints abroad.
In matters not regulated in these Regulations, the provisions of the Civil Code and the Consumer Rights Act apply.
These Regulations are effective from 10.10.2024. Last update: 13.10.2024.
The Store reserves the right to change the Regulations without prejudice to the protection of rights acquired by Customers until the date of the change in the Regulations. All changes to the Regulations are effective from the date of their publication on the Store's website.
